Limited Release By J Michael on 10/18/2008 10:25 AM
I am following “The Hayes Maneuver” in a case right now and it is working to a splendid degree.
It may be more akin to a philosophy, though.
Accent asked me to fax them a copy of the release showing settlement for pain and suffering only and that was enough for them – they closed their file right then and there! Dear Mr. Hayes-If there is an easy answer to this question I would appreciate your guidance. If not, I don’t want to take up your time. Does Alborn apply to a private health insurer who paid medical benefits in a motorcycle accident? Thank you. Regards Charlie L.

Call me tomorrow. The answer is "easy" but requires a little explaining. Ahlborn does not apply. Omnitek & Kazmerski(sp) are keys. 716-852-1111. Call me in the AM. J. Michael

I greatly enjoyed reading your two scholarly articles which you enclosed from the trial lawyer section. In my time, I wrote considerably for publication but without your scholarship. My articles were addressed to policy matters, ethics and trial tactics without any real ruminations on the subject of substantive law. You are a credit to the trial practice in our state and I wish you well in the future.

Mike, Just read your piece in the Bar Bulletin on "liens". Absolutely brilliant! Love your analysis. Problem is it makes too much sense that the courts/legislature would actually accept it. I would suggest publishing it with NYSTLA as well as the NYS Academy of Trial Lawyers, etc. etc. Larry

ECBA Article: It's not often that I read something and feel the urge to write to the author, but I liked your piece in the Bar Bulletin. Although I agree with what you say, I suspect that serious structural reform is more likely to take the form of eliminating tort actions in motor vehicle actions altogether. William A.

Equitible Subrogation By R. M. Esq. on 5/14/2009 9:57 AM
The "authority" on questions such as yours is Buffalo attorney Mike Hayes. That is where I start myself when I have a health care provider subrogation question. I encourage you to contact Mike for what I'm sure will be a better answer than mine.
