I am following “The Hayes Maneuver” in a case right now and it is working to a splendid degree.<br>It may be more akin to a philosophy, though. <br>Accent asked me to fax them a copy of the release showing settlement for pain and suffering only and that was enough for them – they closed their file right then and there! I greatly enjoyed reading your two scholarly articles which you enclosed from the trial lawyer section. In my time, I wrote considerably for publication but without your scholarship. My articles were addressed to policy matters, ethics and trial tactics without any real ruminations on the subject of substantive law. You are a credit to the trial practice in our state and I wish you well in the future.

Mike, Just read your piece in the Bar Bulletin on "liens". Absolutely brilliant! Love your analysis. Problem is it makes too much sense that the courts/legislature would actually accept it. I would suggest publishing it with NYSTLA as well as the NYS Academy of Trial Lawyers, etc. etc. Larry

ECBA Article: It's not often that I read something and feel the urge to write to the author, but I liked your piece in the Bar Bulletin. Although I agree with what you say, I suspect that serious structural reform is more likely to take the form of eliminating tort actions in motor vehicle actions altogether. William A.
